Agreement to these terms

These Terms of Service (“Terms”) are a contract between you and InboxIt (“InboxIt”, “we”, “us”). They govern your use of the website at inboxit.io and the InboxIt application at app.inboxit.io (together, the “Service”). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

The service

InboxIt is a done-for-you cold outreach platform. It helps customers plan, send, and manage email and multi-channel outreach campaigns and route the replies those campaigns receive. The features available to you are those set out in your order or agreement with us.

Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. You must use the Service for business purposes only.

Accounts

InboxIt is done-for-you. Public self-signup is closed, and InboxIt staff create each workspace. You are responsible for keeping your login credentials safe and for all activity under your account. Tell us promptly if you believe your account has been used without your permission. When you connect a third-party mailbox, such as a Google account, you confirm you are authorized to connect it and to send from it.

Acceptable use

You agree that you will not:

  • use the Service to send unlawful, deceptive, or unsolicited bulk messages in breach of anti-spam laws such as CAN-SPAM, GDPR, or CASL;
  • contact people you have no lawful basis or right to contact, or upload lists you do not have the right to use;
  • send content that is illegal, harmful, misleading, infringing, or that violates another person’s rights;
  • breach the terms or policies of any connected provider, including Google and Gmail sending limits and policies;
  • attempt to disrupt, reverse engineer, overload, or gain unauthorized access to the Service.

You are responsible for the content of your outreach and for complying with the laws that apply to it. We may suspend or limit the Service to protect it, our other customers, or third parties.

Your content and responsibilities

You keep ownership of the contact lists, campaign content, and other data you provide (“Customer Content”). You give us the permission needed to host and process it to run the Service for you. You are responsible for the accuracy of Customer Content and for having a lawful basis to contact the people in it. Our handling of personal information is described in our Privacy Policy.

Third-party services

The Service works with third-party services, including Google, to send and manage outreach. Your use of those services is also governed by their own terms and policies, and we are not responsible for them.

Fees

Fees, if any, are those set out in your order or agreement with us. Unless stated otherwise, fees are non-refundable and exclusive of taxes.

Intellectual property

The Service, including its software, design, and content, other than Customer Content, belongs to InboxIt and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service under these Terms. You may not copy, modify, or resell the Service.

Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any particular outreach result will be achieved.

Limitation of liability

To the fullest extent permitted by law, InboxIt will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total liability arising out of or relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the event giving rise to the claim.

Indemnification

You agree to indemnify and hold InboxIt harmless from any claim, loss, or expense arising out of your Customer Content, your use of the Service, or your breach of these Terms or of any law.

Term and termination

These Terms apply while you use the Service. You may stop using the Service at any time. We may suspend or end your access if you breach these Terms, if required by law, or to protect the Service. On termination, your right to use the Service ends, and we handle your data as described in the Privacy Policy.

Governing law

These Terms are governed by the laws of the United States, without regard to conflict-of-law rules, and any dispute will be handled in the courts of that place.

Changes to these terms

We may update these Terms from time to time. When we do, we change the date at the top of this page, and, for material changes, we take reasonable steps to let affected customers know. Continuing to use the Service after a change means you accept the updated Terms.
